The goal of bankruptcy is the discharge – when the debtor is released from personal liability for certain specified types of debts. Unfortunately, your client may commit certain actions that can prevent them from discharging their debt due to Bankruptcy Code Section 727(a).

Bankruptcy Code Section 727(a) & Sanctions

A debtor’s entire discharge can be denied under certain circumstances.  It is an oft-quoted maxim that the fresh start in bankruptcy is limited to the “honest, but unfortunate, debtor.”

In this practical and informative CLE course, Carlos Cuevas and Frank Corigliano will detail the main elements of Section 727(a) and provide numerous hypotheticals and case examples to illustrate how clients can blow their case and be denied from discharging their debt in the bankruptcy proceeding. They will mainly cover the following topics: due diligence at client intake, fraudulent intent & the badges of fraud, concealment & destruction of property and the duty to present adequate books and records.
