We always get SWAMPED this time of year. The phone rings off the hook with procrastinating California attorneys looking to get those 25 required MCLE hours. I am always AMAZED at how many California attorneys don’t have the slightest idea about the CA MCLE requirements.

  • All ethics, bias and competence issues must be done as participatory credit.

California CLE: CA MCLE Compliance Checklist

California attorneys that are in Group 2 (Last names H-M) for MCLE compliance purposes must complete 25 credit hours by January 31 and report CA MCLE compliance by the February 1 CA CLE reporting deadline. California attorneys beware: the State Bar of California has been conducting thousands of MCLE audits each year. CA CLE: California MCLE Deadline is February 1

Don’t worry, there’s is still plenty of time to get your California MCLE done! If you’re an attorney whose last name states with H-M, you still have a few months left to get your required California MCLE done! The deadline is not until February 1, 2018.

25 California MCLEs

If you are a Group 2 (H-M) California attorney you must complete the 25 required MCLE hours by February 1.

Of the 25 required CA MCLE hours, you must complete 4 hours of Legal Ethics, 1 hour of Competence Issues and 1 hour of Elimination of Bias. CA CLE: Complete 25 California MCLE Hours

Group 3 California attorneys…. now is the time!!  California attorneys with last name N-Z, its time to get your CA MCLE done! California Group 3 attorneys must complete 25 hours of minimum continuing legal education (CA MCLE) every three years as part of the California MCLE requirement.

CA CLE Compliance & Reporting

  • California attorneys that are in Group 3 for MCLE reporting purposes are technically required to complete their required CA CLE by February 1, 2017
  • However, if Group 3 (N-Z) California attorneys complete and report their MCLE compliance by March 1, 2017, it will be accepted and they will not be penalized nor will they be assessed a late fee

And don’t forget the specialty credits and 12.5 hours of participatory credit![1] Please note: the State Bar of California has conducted thousands of California MCLE audits over the last few years. CA MCLE: Complete 1 Hour of Competence Issues

Under the California MCLE Rules, attorneys are required to complete 25 hours of minimum continuing legal education (MCLE) every three year CA MCLE compliance period. Due to the increased number of MCLE audits that the State Bar of California is now conducting each year, it is extremely important to properly complete your California MCLE requirement.

Competence Issues

At least one hour of the required California MCLE must address substance abuse or other mental or physical issues that impair a member’s ability to perform legal services with competence.

Please note that the substance abuse requirement is now called the “Competence Issues” requirement. Essentially, the Cal Bar expanded out the substance abuse category to deal with more issues that impair an attorney’s ability to perform legal services with competence.[1] California attorneys must make sure to complete at least 1.0 hour of Competence Issues each three-year compliance period. CA CLE: Four Legal Ethics Required for CA MCLE

California attorneys with last names N-Z (Group 3) must complete the required CA CLE by January 31 and report compliance with the CA MCLE requirement by the March 1 CA CLE reporting deadline.[1] California attorneys need to beware that the State Bar of California has been conducting thousands of California MCLE audits each year.

Required CA MCLE

  • At least 4 of the 25 required CLE hours
  • Must be in the area of Legal Ethics

Please make sure to complete at least 4 hours of Legal Ethics as part of the 25 hour requirement.  Many attorneys forget to complete the correct amount of legal ethics credits. This will make you feel much better if you get one of those CA MCLE audit letters from the State Bar of California in July. CA CLE: California MCLE Compliance & Reporting

Last year the state Assembly rejected the funding for the State Bar of California, thus causing delays in the budget and certain operations of the Cal Bar.  Due to the budget delays, the deadline to pay the annual State Bar fees was also delayed.  This also caused some issues with CA MCLE compliance and reporting.

Technically, California attorneys that are in compliance Group 3 are required to complete and report their required CA CLE by February 1, 2017.  However, if California attorneys complete and report their MCLE compliance by March 1, 2017, it will be accepted and they will not be penalized nor will they be assessed a late fee.[1]  For more information about California CLE please click here: CA CLE.

[1] However, if an attorney decides to take advantage of the grace period by completing and reporting MCLE compliance between February 2, 2017 and March 1, 2017, these CLE courses cannot be used towards the next compliance period.

CA MCLE: Group 3 Attorneys Report CA CLE Compliance by March 1

The California MCLE compliance reporting deadline normally falls on February 1.  However, there was an issue with the State Bar of California and the state legislature this year over the State Bar budget and oversight of the State Bar of California.

This resulted in certain delays at the Cal Bar.  Most notable, the fee statement deadline and the MCLE Reporting deadline for group 3 attorneys has been pushed back to March 1, 2017.  For more information about California CLE please click here: CA CLE.
