CA MCLE: Substance Abuse is now Competence Issues

Quick reminder for California attorneys coming up for MCLE compliance in February 2019.  The former 1 hour Substance Abuse requirement has been expanded out to include mental health concerns and is now called Competence Issues.[1]

CA MCLE Requirements

  • 25 — Total hours
  • 12.5 — Participatory Credit
  • 4 — Legal Ethics
  • 1– Competence Issues
  • 1 — Elimination of Bias

California attorneys must make sure to complete at least 1.0 hour of Competence Issues each 3 year compliance period. Last names A-G must report MCLE compliance by February 1, 2109, on the My State Bar Profile portal on the State Bar of California website. [1] The Substance Abuse category was effectively expanded to cover additional topics: mental health, stress and how it effects an attorneys competence to practice law.

CA CLE: Top California MCLE Myths

We always get SWAMPED this time of year. The phone rings off the hook with procrastinating California attorneys looking to get those 25 required MCLE hours. I am always AMAZED at how many California attorneys don’t have the slightest idea about the CA MCLE requirements.

  • Participatory credit must be take through live courses.
  • All ethics, bias and competence issues must be done as participatory credit.
  • I will be disbarred if I complete my MCLE after February 1

CA CLE: Participatory Credit for Online CLE Courses

Yes, you can take online CA CLE courses for participatory credit!!!  Some California attorneys are under the impression that participatory credit can only be earned by attending live, in-person CLE courses. However, California attorneys may complete their entire 25 credit hour requirement by taking online, downloadable and CD CLE courses.

Participatory & Self-Study

California attorneys may take courses for either self-study or participatory credit. The CA MCLE rules require California attorneys to complete a minimum of 12.5 credit hours of participatory credit each three-year compliance period.

As long as course attendance/completion is verified by a provider, online and downloadable CLE courses may be completed for participatory credit. We verify your online participation through randomly inserted pop ups that you must click to confirm that you are actually viewing the video. For offline courses such as downloadable audio (MP3) and CD courses we verify your course completion via numerical codes embedded in the course.

Group 1 attorneys (last names A-G) need to be aware that the State Bar of California has greatly increased the amount of MCLE audits. Some of these audits are random, while others target specific attorneys that have had previous discipline or MCLE compliance issues with the Cal Bar. California CLE: Self-Study vs. Participatory

California attorneys must complete 25 required CLE credit hours every 3 years to remain in compliance with their California MCLE requirement.  California attorneys must also complete 4 hours of legal ethics, 1 credit hour of Substance Abuse and 1 credit hour of Elimination of Bias as part of this 25 unit requirement.

Online courses, CD ROM-based courses, and some tape-based courses can count for participatory credit if they are verified by an approved provider. If unsure, contact the individual provider to verify that the program has been approved for participatory credit.[1]

California varies from a number of other states in the fact that it allows two different types of credit – self-study and participatory credit.  As part of the 25 unit requirement, California attorneys must complete a minimum of 12.5 of those 25 credit hours for participatory credit.  In order to receive participatory CLE credit for a CA CLE course, the CLE provider must verify your participation in the course.[2]  All of Attorney Credits’ online or offline California CLE courses can be completed for participatory CLE credit.  Before you begin any of our courses you must select your media and verification method, which will determine if you get self-study or participatory credit for the course.
